New Public Transport Tariffs Are Illegal: INATTER Should Support Uphill Necessity with Study

As of March 5, 2018, new tariffs for public passenger transport will be in force by unilateral decision of the Municipality of Maputo. However, there is one aspect that has not been taken into account: the need for the regulator of the land transport sector, in this case, the National Institute of Land Transport (INATTER) to carry out an "ex-ante" study, as determined by Decree No. 32/2011, of August 12, with a view to supporting the need for a rise in tariffs.

One of the essential attributions/competencies of a sectoral regulatory authority in a given economic area is to define the prices to be in force in a given period, independently, that is, to ensure the economic and financial balance of the operators, on the one hand, and, on the other, consumer rights. Such competence, however, was incomprehensibly not attributed to INATTER by law, or in the Decree that created this institution, which leads to the weakening and ineffectiveness of the regulatory activity carried out by the body.
